[Text on screen]: The Supreme Court just ruled that fees to bring Employment Tribunal claims are unlawful. Here are three key things all employees need to know:

If you’re being treated unlawfully you can bring a claim against your employer in the Employment Tribunal. It used to be free but since 2013 you have had t0 pay up to £1200.

The Supreme Court said they were unlawful because they prevented access tp justice.

Judgment: Unison vs Lord Chancellor - “66. The constitutional right of access to the courts is inherent in the rule of law.”

The fees caused a dramatic and persistent fall in the number of claims brought.

Access to a court must be reasonably affordable.

The effect of the judgment is that the fees have been instantly scrapped. The government has promised to pay back up to £132m in fees. People may even be able to bring older claims if they were prevented because of the fees.
